Witness ?
An Expert witness is someone who provides evidence either
by written report and/or physical appearance, in a court or
tribunal where a specialist opinion is required on a particular
issue.
The use of expert witnesses, either in or before
court proceedings is now common practice, especially in the
area of litigation ... and as the world becomes ever more
complex, we find it necessary to rely on the expert knowledge
of those who have become specialists in their chosen field.
What is the Role of
an Expert Witness ?
The role of an expert witness, is to assist the court in the
administration of justice, by providing an opinion or factual
information based on the expert's competence in a subject,
which is outside the knowledge, skill or experience of most
people.
It follows on, that the expert's opinion is
only useful, if it is based on the expert's area of competence,
includes all relevant matters, and is impartial and dispassionate.
Therefore, the primary duty of an expert is
to the court, because of his or her role in the process as
defined above.
It is of course natural, that an expert is subject
to the normal duties in respect of the evidence of fact being
complete, accurate and truthful.
As also stated above, an expert witness's paramount
duty is to the Court and not to the person retaining the expert,
as he or she is not an advocate for any particular party.
